A sugary story of ridiculousness, “Sprinkles Cupcakes” (a California cupcake company) is suing “Famous Cupcakes” for using its trademarked “Modern Dot” cupcake design as a ploy to steal customers. That’s right one cupcake company is suing another for using a giant circular sprinkle in the middle of their cupcake…

Really - is this sue worthy?

It’s a giant sprinkle. If your cupcakes taste good you should have nothing to worry about. Also - like I said - IT”S A GIANT SPRINKLE. I mean I know we live in a day and age where branding is super important, but when it comes down to it, the people that would mix the two companies up aren’t coming to shop for your name anyways, they’re probably coming because they want some cake and you’re nearby.

But I digress. What we should really be talking about is how people pay upwards of 4 dollars for a little piece of cake with a giant sprinkle on it.. Seems super silly to me.

I say, bake your own cupcakes and put whatever design on it that you like.

  2. Ugh. This actually got me bent enough that I wrote my first hate mail. It’s not even so much about how stupid the lawsuit is, it’s about being pretentious enough to believe you own the rights to a design style started in the late 50’s. I asked them if they were going after Target next for having the same design all over their Choxie brand of chocolates.

  3. Thank you! I read about this on Cupcakes Take The Cake and couldn’t believe the absurdity. Apparently though, Sprinkles doesn’t want anyone else to use the word “sprinkles” in their bakery name (they had a bakery named SprinkleSprinkle change their name because they thought it would create confusion) or use a freakin’ dot shaped sprinkle on top of cupcakes.

    It’s cupcakes. Why are people being sued over cupcakes? So silly.

  4. Funny thing - a bunch of us girls were out (like 10 of us) and talking about the fact that someone had heard a rumor that Sprinkles was coming to our city. Then someone mentioned that Sprinkles was “sue happy” and was suing every little business under the sun. Well, 3 of us happen to be small business owners and quickly the sentiment turned from something that should be reminiscent of childhood to all of us making a pact to picket Sprinkles should they ever come to our city. I am personally FLOORED that a person who started small would FORGET what it is all about.

    Shame on you.
